TERMS OF USE
The services Front Line Success Systems, LLC (hereinafter “Front Line Transitions”) maintains through its Front Line Transitions website are accessible through the home page to adults who consent to the following terms and conditions of use and any amendments posted on Front Line Transitions site. Since Front Line Transitions is not responsible for the content of any site linked from or linked to the Front Line Transitions site, you are advised to review the particular terms and conditions of that site.
1. Membership Eligibility: The services displayed on the Front Line Transitions site are available to adults who can form legally binding contracts under applicable law. An adult is defined as an individual over the age of 18 or the age of consent in the jurisdiction from the Front Line Transitions site is being accessed. Front Line Transitions shall consider all other individuals (i.e. clients under the age of 18 accessing
our site) minors who must first obtain written permission from their parent or legal guardian prior to participating in Front Line Transitions’ member-restricted services.
2. Responsibilities:
A. Your Conduct:
The Front Line Transitions site is for the personal use of members, who agree to: (i) provide truthful information and abide by the Code of Ethics and the Privacy Policy ; (ii) not permit others to use the Member Login Name and Password assigned by Front Line Transitions to them in conjunction with their non-transferable Front Line Transitions membership or credit card; and (iii) interrupt or
attempt to interrupt the operation of Front Line Transitions site in any way or to assist or authorize others in the reverse engineering of, decompiling of, and or disassembling of the software on the Front Line Transitions site. Additionally, members are not permitted
to distribute exchange, modify, sell or transmit anything copied from this site or as part of the coaching sessions for any business, commercial or public purpose.
With respect to chat rooms, bulletin boards and/or other interactive parts of the Front Line Transitions site, you agree not to post, send, transmit, upload or otherwise publish through the Front Line Transitions site any materials which in Front Line Transitions’ sole opinion (i) restricts or inhibits other members from using and enjoying said services; (ii) are abusive, defamatory, indecent, obscene,
offensive or threatening in any way; (iii) encourage others to conduct themselves in a manner which would be considered a criminal offense or give rise to civil liability, or otherwise violate any law; (iv) violate another’s copyright or other property right; (v) contain a virus or any other harmful component; and/or (vi) contain false statements concerning the origin of the material or the communication.
You understand that all such communications which take place upon entering a chat room as well as all communications posted on bulletin boards and other interactive parts (excluding coaching) of the Front Line Transitions site are non-confidential and non- proprietary. Accordingly, you give up any claim that any use by Front Line Transitions of such communications violates any of your rights (including but not limited to moral, privacy, proprietary and publicity rights).
B. Front Line Transitions Conduct:
Front Line Transitions coaches will provide all military transition coaching services as outlined on our homepage and website descriptions. These services, for individuals participating in the entire Front Line Military Transition Coaching Program include a certain number of hours of contact between coach and client employing any combination of in-person, telephone or cyber coaching as agreed upon by client and coach. For individuals participating in a Customized Military Transition or Personality Assessment Program, also offered by Front Line Transitions, the time spent between client and coach (online and/or via the telephone) will vary accordingly. All Front Line Transitions Coaches will adhere to the Front Line Transitions Code of Ethics as well as the International Coach Federation Code of Ethics. They are highly trained and caring professionals who have achieved, or are pursuing, their Coaching Certification through the International Coach Federation.
Depending upon the chosen level of service, your Front Line Transitions Coach will perform the following:
• Conduct individual coaching sessions by telephone or cyberspace to help you formulate career and life goals and an appropriate transition plan.
• Engage you in examining your interests, skills, values, needs and personal style with a view towards exploring related career and business opportunities.
• Assist in making appropriately related short term and longer terms career and life decisions with an emphasis on self- empowerment and self-management.
• Provide advice and insight based on current trends in career and business development as well as offering referrals to experts in fields such as resume writing, employment recruiters, financial planning, new business startups, and job search strategies.
Military Transition Coaching Clients will have the opportunity to communicate with their assigned coach by e-mail between scheduled sessions. Coaches will respond to requests for contact in a timely manner, and in the case of an emergency, clients are instructed to contact the main number at Front Line Transitions Office: (505) 344-0121.
While your Front Line Transitions coach is totally committed to supporting you, and working with and for you during this process, we offer no guarantees regarding getting a job, starting or assuming a business. Effective military transition planning requires sincere commitment by Front Line Transitions clients and coaches as they partner to achieve realistic and concrete goals.
Front Line Transitions Clients understand that the coaching relationship is not in any way to be construed as psychological counseling or any type of therapy. In the event that the client feels the need for professional counseling or therapy, it is the client’s responsibility to seek a licensed professional. If the Front Line Transitions Coach suspects the need for a different type of professional, they will discuss it with the client.
C. Notice:
Furthermore, you agree to inform Front Line Transitions of any apparent breaches of security, such as loss, theft, unauthorized disclosure or use of your Member Login Name and Password or credit card. This notification shall be by one of the following means: (i) sending an e-mail to admin@FrontLineTransitions.com; (ii) by calling (505) 344-0121; (iii) faxing details of incident to (505) 344-
0738 or (iv) by regular first class mail postage prepaid to Front Line Success Systems, LLC, 6100 4th Street NW, Suite 284, Albuquerque, NM 87107. YOU, AND NOT FRONT LINE TRANSITIONS, ARE RESPONSIBLE FOR YOUR BEHAVIOR AND THE BEHAVIOR OF THOSE WHO, WITHOUT YOUR AUTHORIZATION, USE YOUR FRONT LINE TRANSITIONS MEMBERSHIP AND/OR CREDIT CARD.
D. Termination & Refunds:
Front Line Transitions will automatically, without further notification, terminate memberships of clients who fail to abide by the aforementioned user’s responsibilities and notice provisions. Payment made for the current month shall be considered full payment for the coaching agreement. There will be no partial monthly refunds.
Any client may terminate the coaching program at any time. Payment made for the current program shall be considered full payment for the coaching agreement. There will be no partial or prorated refunds.
A client who has abided by all of the aforementioned user’s responsibilities and notice provisions may seek to terminate the Front Line Transitions’ services and request a refund within 30 days of initial payment. (If your participation is being paid for or sponsored by a third party individual or institution this will not apply.) This request for cancellation of the membership and/or coaching program must be in writing either by sending an e-mail to admin@FrontLineTransitions.com, or by faxing the request to (505) 344-0738, or by writing a letter and sending it by regular first class mail postage prepaid to Front Line Success Systems, LLC, 6100 4th Street NW, Suite 284, Albuquerque, NM 87107. Termination shall be effective immediately upon Front Line Transitions acknowledgment of receipt of said notification. Termination requests received after 30 days of initial payment being received shall not be honored.
However, where the client’s conduct has in any way violated the Front Line Transitions code of ethics or has prevented Front Line Transitions from delivering the services as outlined in this agreement, then no refund will be issued to the client or individual sponsoring the client. Additionally no refund will be issued due to technical difficulties in a client’s ability to access the Front Line Transitions site.
3. Limitation of Services Due to Technical Difficulties:
Since Front Line Transitions cannot control your ability to access the Front Line Transitions site at any particular time, the services provided on the Front Line Transitions site are on an “as-is, as-available” basis. If you are unable to obtain interactive access due to financial or a related limitation, you may gain such access through a local public library.
While we do our best efforts to employ industry standard practices in striving to protect your privacy on the Front Line Transitions site, we cannot ensure or warrant the security of any information you transmit to us (or a linked site) over the Internet. BY USING THE FRONT LINE TRANSITIONS SITE, YOU RECOGNIZE THAT TRANSMISSIONS OVER THE INTERNET ARE AT YOUR OWN RISK AND THAT THIRD PARTIES MAY, DESPITE OUR BEST EFFORTS, UNLAWFULLY INTERCEPT OR ACCESS SAID TRANSMISSIONS.
4. Disclosures:
Coaching records, including interview information, will be maintained for a period of 5 years. This information will be maintained in confidence within the professional and/or administrative staff of Front Line Transitions, disclosing such information to third parties other than professional and/or administrative staff only where a client’s situation suggests a clear and imminent danger to self and/or others or where such disclosure is required by law, regulation or legal process as set forth in the Privacy Policy the terms of which are incorporated by reference herein. You understand that such confidentiality is subject to the security limitations mentioned in Paragraph 3 above.
5. Indemnification:
You agree to indemnify Front Line Transitions, its coaches, directors, officers, employees, agents, successors and assigns, for any losses, costs, or damages, including reasonable attorneys’ fees incurred by Front Line Transitions and relating to, or arising out of any dispute pertaining to violations of the privacy policy, this agreement and any content or software placed on Front Line Transitions site.
6. Disclaimer of Warranties and Damages; Limitation of Liability:
FRONT LINE TRANSITIONS SERVICES ARE PROVIDED TO YOU “AS IS” WITHOUT WARRANTY OF ANY KIND,
EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR INFRINGEMENT. SOME STATES DO NOT ALLOW
THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
IN NO EVENT WILL FRONT LINE TRANSITIONS , ITS COACHES, DIRECTORS, SUPERVISORS, OFFICERS,
EMPLOYEES, AGENTS, SUCCESSORS AND ASSIGNS, BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE FRONT LINE TRANSITIONS SITE, EVEN IF FRONT LINE TRANSITIONS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. IN NO EVENT WILL FRONT LINE TRANSITIONS, ITS COACHES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUCCESSORS AND ASSIGNS, BE LIABLE TO YOU FOR ACTUAL DAMAGES FOR ANY CAUSE WHATSOEVER, REGARDLESS OF THE FORUM OF ACTION (WHETHER SOUNDING IN TORT, CONTRACT, OR OTHERWISE) WHICH EXCEED THE MEMBERSHIP FEES PREVIOUSLY PAID.
IN THE EVENT THAT FRONT LINE TRANSITIONS COMMENCES ANY ACTION OR PROCEEDING AGAINST YOU BY
REASONS OF ANY BREACH OR CLAIMED BREACHED IN THE PERFORMANCE OF ANY OF THE TERMS OR
CONDITIONS OF THIS AGREEMENT AND/OR THE PRIVACY POLICY , OR SHALL SEEK A JUDICIAL DECLARATION
OF RIGHTS HEREUNDER, YOU SHALL BE LIABLE FOR ALL COSTS AND EXPENSES, INCLUDING, WITHOUT
LIMITATION, LEGAL COSTS AND REASONABLE ATTORNEYS FEES INCURRED BY FRONT LINE TRANSITIONS IN
ENFORCING THIS AGREEMENT AND THE PRIVACY POLICY . THESE AFOREMENTIONED COSTS, EXPENSES AND
FEES ARE NOT SUBJECT TO COURT APPROVAL. IF YOU COMMENCE ANY ACTION OR PROCEEDING AGAINST FRONT LINE TRANSITIONS BY REASON OF ANY BREACH OR CLAIMED BREACH IN THE PERFORMANCE OF ANY OF THE TERMS OR CONDITIONS OF THIS AGREEMENT AND/OR THE PRIVACY POLICY, OR SHALL SEEK A JUDICIAL DECLARATION OF RIGHTS HEREUNDER, THEN IF FRONT LINE TRANSITIONS IS THE PREVAILING PARTY IN SUCH ACTION OR PROCEEDING IT SHALL BE ENTITLED TO ALL COST AND EXPENSES, INCLUDING, WITHOUT LIMITATION, LEGAL COSTS AND REASONABLE ATTORNEYS FEES. THESE AFOREMENTIONED COSTS, EXPENSES AND FEES ARE NOT SUBJECT TO COURT APPROVAL.
SUCH LEGAL ACTION OR PROCEEDING SHALL BE BROUGHT IN A COURT OF COMPETENT JURISDICTION IN THE COUNTY OF BERNALILLO, STATE OF NEW MEXICO. THIS AGREEMENT AND THE PRIVACY POLICY SHALL BE
GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF NEW MEXICO, EXCEPT
THE CONFLICTS LAWS. THE PARTIES CONSENT TO PERSONAL JURISDICTION AND VENUE IN NEW MEXICO.
7. Entire Agreement:
With the exception of subsequent amendments posted on Front Line Transitions site, this agreement constitutes the entire agreement between the parties and may not be otherwise amended, modified, or rescinded in any way except by a writing signed by both parties. No representations, statements or inducements, oral or written, not contained herein or in subsequent amendments shall bind either of
us.
8. Severability:
If any provision of this Agreement or its subsequent amendments are determined by a court of competent jurisdiction to be invalid, illegal or unenforceable, such provision shall be limited to the extent necessary to eliminate such illegality, invalidity or unenforceability, and if such provision cannot be so limited then such provision shall be treated as if it was never part of this Agreement or its subsequent amendments, without affecting the validity, legality or enforceability of such provision in any other jurisdiction or of any provision thereof.
9. Miscellaneous:
The English language version of this Agreement as well as the subsequent amendments thereto and the Privacy Policy as well as the subsequent amendments thereto shall be the official version and shall be effective immediately upon posting.

Front Line Transitions Clients may contact the Front Line Success Systems, LLC Operations Manager at (505) 344-0121 at any time with comments or questions concerning the quality of services being provided by our organization or about the ethical practices of our Front Line Transitions Coaches as outlined in our FRONT LINE TRANSITIONS COACHING CODE OF ETHICS. You may view the International Coach Federation (ICF) Code of Ethics and contact the ICF Ethics Board through http://www.coachfederation.org. You may also direct questions regarding coaches and coaching practices to admin@FrontLineTransitions.com.
